PINNACLE: Tennis Courts & Swimming Pool Exposure
Dear Mr. Passmonick,
Although I have been quite concerned over the actions and decisions the Board has made these past two years, this is being written more in the capacity of a Licensed Professional Engineer, with more than 40 years experience in the field of loss prevention.
Now, after much encouragement - I did visit the Pinnacle and Eagle Crest Golf Course for the purpose of making a determination as captioned. There is indeed an exposure to users of these facilities, from golf balls coming in from the 18th fairway. As I see it, there are two possibilities;
1. A powerful hitter, off the "T" could hit the cart path and bounce into either facility.
2. A bad "T" shot would result in a possible bad second shot - and again hitting the cart path or
airborne could reach these facilities.
My visit was with two other engineers - and as things would have it a foursome coming off the "T" did indeed place their "T" shot at the tennis courts. The foursome consisted of the General Manager of Pride Dodge, a Mr. Jamie Boast (221-0000), and other members from Pride Dodge. Being concerned with almost hitting us, Mr. Boast inquired as to our activities and then proceeded to inform us that - he is a regular player at Eagle Crest and has placed several "T" shots into the swimming pool.
A number of other people have verified that golf balls had indeed entered these facilities, even with the elevation of fencing at the tennis courts.
I am deeply concerned over the Board's consideration of accepting this facility from the developer with this condition existing. I respectfully call to the Board's attention Criminal Gross Negligence (Black's Law Dictionary), which emphatically describes the exposure each Board member has, should any of the above scenarios take place.
Mr. Passmonick, on behalf of the many of us who have been watching the Board's activities, I would like to thank you for looking out for the best interests of those of us who have elected you. Having served on Associations Boards, I know how difficult it is for one to maintain their integrity, while facing a great deal of adversity.
Respectfully submitted,
Robert J. Kopp, P.E.
