OBSERVATION & PROPOSAL


David;

Observation: you and I only want the best for our community; however we see these interests from different prospective. From my prospective I view Sun City as a community governed by an HOA and the CC&Rs that are imbedded in your property deed. As a Director your responsibility is to protect the assets of our Association, including By-Laws, CC&R's, Amenities and Lifestyles; a homeowner is a full partner in this common interest community and deserves these protections provided by this community's governing documents and should be respected by leadership and management.

The Board has isolated themselves from the homeowners creating distrust; this lack of trust led to the unacceptable actions by the Boards leadership by not allowing a homeowner the right to speak at the October 19, 2009 Board Meeting. I and many other homeowners have been ignored by the Board and management as outlined in my complaint I delivered October 15, 2009 to the Association office for placement on the November 16th agenda.

Proposal: David, I believe you have the ability and personality to broker a resolve to the problems that are destroying our community, this could be accomplished by all parties sitting around the table like ladies and gentlemen, not at a Board meeting with a Board controlled Residents Comment session. I would suggest enlisting Bud Cook in this project, at this point Bud is not controversial, I am also available if needed.  It is important that both party's, the homeowner and the Board, realize the importance of the Governing Documents of this common interests community and abide by them. The goal would be to solve community concerns without public displays like we had at the October 19th Board meeting.

Dear Mr. Winkel,

In accordance with NRS 116.31087 as amended by the Nevada State
Legislature in the 2009 Session, I request that you place the
following complaints on the agenda at the Board of Directors meeting
November 16, 2009.

COMPLAINTS:

1. DECEPTION: The Board and Management have repeatedly misled, deceived
and lied to homeowner's regarding existence of a Business Plan for Sun City
businesses creating well over $2,000,000 yearly losses for our community. At
the August 31, 2009 Board meeting I petitioned the Board for the
implantation of a Standard Business Plan for the Sun City Businesses after
finding out that no such Plan existed. President Post has instructed Board
members and Management (Mr. Winkel) not to respond to my correspondence and
ignore issues that pertain to the existence of a Business Plan.

2. SUPPRESSION: Mr. Post and the Board of Directors have failed to make
Attorney Opinions available to the homeowners; the Attorney Opinions were
the bases of decisions made that affect the homeowner's property value and
lifestyle.

3. Electoral fraud: On January 26, 2009 I sent a letter outlining a
blatant case of "ELECTIONEERING" by the officers of the Resident Form to Mr.
Barry Goldman who chaired the Election Committee w/cc: to the BoD. Mr. Barry
Goldman promptly responded with a letter dated January 28, 2009
acknowledging receipt of my correspondence that states "the intention and
purpose of this correspondence is to go on written record...." I did cc:
this correspondence to the Board asking for a written response in this
matter. Mr. Post and the Board chose to ignore these actions of a relatively
small group that has gained control over our Sun City Committee's.

RELIEF SOUGHT:


1. Inform the Sun City Summerlin homeowners by US-Mail and the Link
publication regarding the non existence of a Business Plan costing our
community approximately $6500.00 per day. I also request the formation of an
independent Commission to apply the components of a Business Plan for
Established Businesses to the Sun City Businesses.

2. Sun City homeowners demand honesty, openness and transparency from
their elected Board members as stated in the governing documents; therefore.
release all Attorney opinions used in decisions made by the Board on behalf
of the homeowners.

3. Electoral fraud: A prompt and full investigation of the facts
involving the officer's of the Residents Form and their committee members in
the last Sun City election.
